Keeping your AI data in India, explained
What the DPDP Act means for AI projects, the three hosting options you have, and how to choose between them without over-engineering.
“Where does our data go?” is now one of the first questions compliance teams ask about any AI project. For banks, NBFCs, hospitals and law firms, the answer can decide whether a project goes ahead at all.
This article is a general overview, not legal advice. Check the specific requirements for your sector with your compliance team.
Why it matters
India’s Digital Personal Data Protection (DPDP) Act sets rules for how personal data is collected, used and protected. Sector regulators such as the RBI, IRDAI and health authorities add their own expectations on where data is stored and who can access it. Sending customer documents to an AI service hosted abroad can raise questions under any of these.
Option 1: Cloud AI services in an Indian region
The major cloud providers offer AI models hosted in their Indian regions. This is the quickest option. It suits many use cases, as long as you check the provider’s data handling terms: whether your data is stored, for how long, and whether it’s used for training.
Option 2: Open models in your own cloud account
Open models can run inside your own AWS, Azure or Google Cloud account in an Indian region. Your data never leaves infrastructure you control, and no outside AI provider sees it. This needs GPU capacity and someone to maintain it, but it gives you full control and a clear audit trail.
Option 3: Dedicated private servers
For the most sensitive work, models can run on dedicated servers in an Indian data centre, run by your own IT team or a hosting provider. This is the strongest option for data control, but needs the most in-house expertise.
How to choose
- Low-sensitivity data, like public product information: option 1 is usually fine.
- Customer personal data in regulated sectors: option 2 or 3.
- Very high volume: dedicated servers often cost less per request than paying per use.
Don’t forget the rest of the system
Hosting the model in India is only part of it. Also check where your documents are stored, where logs go, who can see conversation history, and how access is controlled. A private assistant is only as private as its weakest part.
